Terms of Service

The short version: this is practice material, not tutoring and not a guarantee. Nobody can promise your child a selective school place, and anyone who does is selling you something. We are not connected to NESA or the NSW Department of Education. You can cancel whenever you like.

1. The agreement

These terms are between you and Akanksha Srivastava (ABN 56 135 039 755) of New South Wales, Australia (“we”, “us”). Creating an account means you accept them. If you do not, do not create one.

2. What the service is

Selective Ladder is a practice tool. It covers a deliberately narrow set of topics: things the NSW K–6 syllabus does not teach, teaches later, or teaches to a lower ceiling than the selective and Opportunity Class tests require. It is not a school curriculum, not a tutoring service, and not a substitute for either.

What we do not promise

  • Any result. We cannot and do not guarantee a selective high school place, an Opportunity Class place, a NAPLAN band, or any improvement at all. Results depend on your child, the other candidates, and decisions made entirely by others.
  • Coverage of the real test. The tests change. Our topics are our own reading of what they demand, not an official specification.
  • That we are official. We are not affiliated with, endorsed by, or connected to the NSW Education Standards Authority, the NSW Department of Education, the Australian Curriculum, Assessment and Reporting Authority, or any school. Names of tests and syllabuses are used only to describe what we practise for.

3. Who may use it

You must be at least 18 and the parent or guardian of the child using the account. One account is for one family. You are responsible for what happens under your account, so keep the password to yourself — it must be at least 10 characters.

4. Your child using it

The practice screens are built for a young child to use with a grown-up nearby. You decide how much they use it and when to stop. Accuracy below 70% on a topic is the app telling you it is too hard for now; the right response is to back off, not to push.

5. What you may and may not do

Yes

Use it for the children in your own family, on as many of your own devices as you like, for as long as your subscription runs.

No

  • Sharing your account outside your household, or selling access to it
  • Using it to run a tutoring business or a class
  • Copying, scraping, bulk-downloading or republishing the questions, topics or explanations
  • Automated access, reverse engineering, or trying to get at other accounts or the question bank
  • Anything that interferes with the service for other people

We can suspend or close an account that breaks these rules. Where it is fair to do so, we will warn you first.

6. Trial, price and billing

New accounts get a 14-day free trial. No card is required to start it, and nothing is charged when it ends — access simply stops until you subscribe.

A subscription covers the school years you select. You may change that selection at any time, and the price follows it from the next billing period. Prices are in Australian dollars, billed monthly in advance:

Selecting four or five years costs the same AU$45 as selecting all six, so a selection of four or more is treated as all six years and is charged at AU$45 per month.

These prices carry no GST. We are not registered for GST, so none is charged and none is included in the amounts above. If we become registered we will tell you before it affects what you pay.

When paid subscriptions are switched on, payments will be handled by Stripe. Subscriptions renew automatically until you cancel. Card details go to Stripe and never reach our servers. Prices may change, but not during a period you have already paid for, and we will give you at least 30 days’ notice by email before a change affects you.

7. Cancelling and refunds

Cancel any time. You keep access until the end of the period you have paid for, and you are not charged again.

Beyond your rights under the Australian Consumer Law (section 8), we do not generally refund part-used periods — the free trial is there so you can decide before paying. If something has genuinely gone wrong, write to us; we would rather sort it out than argue about it.

8. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to cancel and get a refund of the unused part, and to compensation for any other reasonably foreseeable loss. If the failure is not major, you are entitled to have it fixed within a reasonable time, and to cancel and get a refund if it is not.

Nothing in these terms limits those rights. Where anything here conflicts with them, they win.

9. Availability and changes

We aim to keep the service running but do not promise it will be uninterrupted or error-free. We may need to take it down for maintenance, and we may add, change or remove topics and features as our reading of the tests changes.

If we ever shut the service down for good, we will give you at least 30 days’ notice by email and refund any period you have paid for but not used.

10. Who owns what

The questions, topics, explanations, wording, design and code are ours, and stay ours. Your subscription is permission to use them, not a transfer of ownership. Your own information stays yours — see the Privacy Policy for how we handle it.

11. Liability

Subject always to section 8, and to the extent the law allows:

None of this limits liability for fraud, or for anything else the law does not permit us to limit.

12. Ending the agreement

You can close your account at any time by writing to us. We can close or suspend an account that breaks section 5, that is used fraudulently, or where we are required to. If we close your account without cause, we refund the unused part of what you have paid.

Closing an account deletes the practice history attached to it, and it cannot be recovered.

13. Governing law

These terms are governed by the law of New South Wales, Australia. Courts there have jurisdiction, which does not take away any right you have to bring a matter in your home State or Territory.

14. Changes to these terms

We may update these terms. The date at the top shows the current version. If a change materially affects you, we will email the address on your account at least 30 days before it takes effect. Continuing to use the service after that means you accept the change; if you would rather not, cancel and we refund the unused part of your period.
